The "crime" is so minor it makes Nintendo look pettier than usual. It's not like they're entering this gen on the best foot as it is, so it's not in their best interest to start burning bridges with early adopters. I don't see any positive outcome for Nintendo in banning people for the "crime" of modifying a small portion of their Wii Us to play games they should be able to play anyway.
